Article 1 \u2013 Definitions<\/strong><\/h2>\n\n\n\n

In these Terms and Conditions, the following definitions apply:<\/p>\n\n\n\n

  • Withdrawal Period:<\/strong> The time period during which the consumer may exercise the right of withdrawal.<\/li>\n\n\n\n
  • Consumer:<\/strong> Any natural person acting for purposes outside their trade, business, or profession.<\/li>\n\n\n\n
  • Day:<\/strong> Calendar day.<\/li>\n\n\n\n
  • Durable Medium:<\/strong> Any medium that allows the consumer or trader to store information in a way that permits future reference and unchanged reproduction.<\/li>\n\n\n\n
  • Right of Withdrawal:<\/strong> The consumer\u2019s right to withdraw from a distance contract within a specified period.<\/li>\n\n\n\n
  • Trader \/ Company:<\/strong> PaintingsCart.<\/li>\n\n\n\n
  • Distance Contract:<\/strong> Any agreement concluded exclusively through remote communication methods.<\/li>\n\n\n\n
  • Remote Communication:<\/strong> Means of concluding a contract without the simultaneous physical presence of the parties (e.g., website, email).<\/li>\n\n\n\n
  • T&C:<\/strong> These Terms and Conditions of PaintingsCart.<\/li>\n<\/ul>\n\n\n\n

    Article 3 \u2013 Scope of Application<\/strong><\/h2>\n\n\n\n

    These Terms and Conditions apply to all offers and distance contracts between PaintingsCart<\/strong> and consumers.<\/p>\n\n\n\n

    A copy of these Terms will be provided before the conclusion of any contract. If that is not possible, the consumer will be informed where the Terms can be accessed electronically.<\/p>\n\n\n\n

    Any deviations from these Terms apply only if they are more favorable to the consumer.<\/p>\n\n\n\n

    Invalid provisions do not affect the validity of the remaining Terms.<\/p>\n\n\n\n

    Any matters not expressly covered will be interpreted in the spirit of these Terms.<\/p>\n\n\n\n

    Article 4 \u2013 Offers<\/strong><\/h2>\n\n\n\n

    All offers are non-binding and subject to change.<\/p>\n\n\n\n

    Every offer includes a clear product description. Images correspond to actual products, though minor color variations may occur.<\/p>\n\n\n\n

    Each offer provides information about:<\/p>\n\n\n\n

    • The total price (excluding import VAT and customs duties payable by the customer);<\/li>\n\n\n\n
    • Shipping costs;<\/li>\n\n\n\n
    • How the contract is concluded;<\/li>\n\n\n\n
    • The right of withdrawal;<\/li>\n\n\n\n
    • Payment, delivery, and performance conditions;<\/li>\n\n\n\n
    • The validity period of the offer;<\/li>\n\n\n\n
    • The contract language (German or English);<\/li>\n\n\n\n
    • Complaints procedure;<\/li>\n\n\n\n
    • Return policy;<\/li>\n\n\n\n
    • Optional details such as sizes, materials, and colors.<\/li>\n<\/ul>\n\n\n\n

      Article 5 \u2013 Contract Formation<\/strong><\/h2>\n\n\n\n

      A contract is formed when the consumer accepts the offer and meets all related conditions.<\/p>\n\n\n\n

      Acceptance will be confirmed by email.<\/p>\n\n\n\n

      Payments and data transmissions are handled through secure connections.<\/p>\n\n\n\n

      PaintingsCart reserves the right to reject orders for legitimate reasons (e.g., suspected fraud, incomplete information).<\/p>\n\n\n\n

      Upon delivery, the consumer will receive:<\/p>\n\n\n\n

      • Contact details for customer support;<\/li>\n\n\n\n
      • Instructions on the right of withdrawal;<\/li>\n\n\n\n
      • Warranty terms;<\/li>\n\n\n\n
      • Information required under Article 4(3);<\/li>\n\n\n\n
      • Termination rules for ongoing contracts.<\/li>\n<\/ul>\n\n\n\n

        Article 6 \u2013 Right of Withdrawal<\/strong> ( ONLY VALID FOR EU )<\/h2>\n\n\n\n

        Consumers may withdraw from the contract within 14 days<\/strong> after receiving the goods, without giving any reason.<\/p>\n\n\n\n

        Returned items must be unused<\/strong> and in their original packaging<\/strong>.<\/p>\n\n\n\n

        The withdrawal must be made in writing or by email within 14 days. The goods must then be returned within an additional 14 days.<\/p>\n\n\n\n

        \n\n\n\n

        Article 7 \u2013 Costs of Withdrawal<\/strong><\/h2>\n\n\n\n

        The consumer bears the cost of return shipping<\/strong>.<\/p>\n\n\n\n

        Refunds will be processed within 14 days<\/strong> after receipt of the withdrawal notice or proof of return.<\/p>\n\n\n\n

        Article 8 \u2013 Exclusion of Withdrawal<\/strong><\/h2>\n\n\n\n

        The right of withdrawal does not apply to:<\/p>\n\n\n\n

        • Custom-made or personalized products;<\/li>\n\n\n\n
        • Items unsealed for hygiene reasons;<\/li>\n\n\n\n
        • Digital products once download or streaming has begun;<\/li>\n\n\n\n
        • Perishable goods.<\/li>\n<\/ul>\n\n\n\n
          \n\n\n\n

          Article 9 \u2013 Prices<\/strong><\/h2>\n\n\n\n

          Prices are listed in USD<\/strong> and exclude import VAT and customs duties, which are payable by the recipient.<\/p>\n\n\n\n

          Typographical or pricing errors do not constitute a binding agreement. PaintingsCart is not liable for printing or display errors.<\/p>\n\n\n\n

          \n\n\n\n

          Article 10 \u2013 Warranty and Guarantee<\/strong><\/h2>\n\n\n\n

          Products comply with statutory quality standards.<\/p>\n\n\n\n

          Defects must be reported within 1 days<\/strong> of delivery. The product must be unused and in its original packaging.<\/p>\n\n\n\n

          Manufacturer warranties apply as stated by the producer. PaintingsCart is not liable for damages caused by:<\/p>\n\n\n\n

          • Unauthorized repair or modification;<\/li>\n\n\n\n
          • Improper use;<\/li>\n\n\n\n
          • Damage due to official regulations or inspections.<\/li>\n<\/ul>\n\n\n\n
            \n\n\n\n

            Article 11 \u2013 Delivery<\/strong><\/h2>\n\n\n\n

            Delivery will take place within 7-21 days<\/strong>, unless otherwise agreed.<\/p>\n\n\n\n

            If delivery is delayed, the consumer may cancel the contract free of charge.<\/p>\n\n\n\n

            Replacement products will be clearly marked as such. The consumer retains the right of withdrawal. In this case, PaintingsCart will cover the cost of return shipping.<\/p>\n\n\n\n

            The risk of loss or damage passes to the consumer upon receipt of the goods.<\/p>\n\n\n\n

            \n\n\n\n

            Article 12 \u2013 Contract Duration and Termination<\/strong><\/h2>\n\n\n\n

            Open-ended contracts may be terminated by either party with one month\u2019s notice<\/strong>.<\/p>\n\n\n\n

            Fixed-term contracts end automatically upon expiry and will not renew without explicit prior consent.<\/p>\n\n\n\n

            Long-term contracts may be terminated after one year with one month\u2019s notice<\/strong>.<\/p>\n\n\n\n

            Article 13 \u2013 Payment<\/strong><\/h2>\n\n\n\n

            Payment must be made within 2 working days<\/strong> after order confirmation.<\/p>\n\n\n\n

            The consumer must promptly report any incorrect payment or billing details.<\/p>\n\n\n\n

            In case of late payment, PaintingsCart reserves the right to charge reminder or processing fees.<\/p>\n\n\n\n

            Article 14 \u2013 Complaints<\/strong><\/h2>\n\n\n\n

            Complaints must be submitted in writing within 1 days<\/strong> of receiving the product.<\/p>\n\n\n\n

            A response will be provided within 14 days<\/strong>. If more time is needed, the consumer will be informed of the delay.<\/p>\n\n\n\n
